The following terms and conditions (“Term Sheet”) apply to the Messaging product and features (“Messaging”) and are incorporated by reference into the applicable Service Order and form part of the Agreement with the Client, along with JobTarget’s General Terms and Conditions, Terms of Use and Privacy Policy, as set forth in the Service Order. This Term Sheet further applies to the purchase of services through JobTarget’s website. JobTarget may modify these terms at any time. By continuing to use JobTarget’s services, you are agreeing to any such modified terms.
Acceptable Use
Messaging shall not be used:
- For any purpose other than communicating and connecting with individuals relating to job opportunities. Any other use is strictly forbidden;
- To contact job seekers and candidates about anything other than legitimate and current job openings;
- To contact job seekers and candidates for any types of illegal services or jobs which require any type of payment from the job seeker or candidate;
- To send messages, emails or text messages or make phone calls to job seekers or candidates that are excessive in frequency or unrelated to job openings or to job seekers or candidates who have indicated that such communications are unwanted. Messaging is not intended to be used to send bulk messages;
- To send messages that are unprofessional, derogatory, insensitive, racist, sexist, or use other types of potentially offensive language; or
- In any discriminatory, biased, illegal or fraudulent manner or otherwise not in accordance with applicable laws and regulations.
Data
- By viewing, sending, receiving, or storing communications, documents, and information (“Data”) through Messaging or on JobTarget’s website or services, Client agrees that such Data may be collected, processed, analyzed, reviewed and stored by JobTarget and/or its third-party vendors for analysis, quality control and performance, operation or improvement of the product and services, content moderation, or enforcement of JobTarget policies or terms, which may include the use of automation, artificial intelligence or machine learning to perform such functions, in accordance with JobTarget’s Privacy Policy.
- Client agrees that its use of Data must be in compliance with applicable privacy and data protection laws.
Beta Version
- JobTarget may offer Messaging in a beta version. Beta products may be offered in limited quantities and for a limited time. JobTarget may cancel or discontinue a beta product at any time without prior notice.
- ANY BETA PRODUCT IS IN TESTING PHASE AND IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND MAY CONTAIN DEFECTS. A PRIMARY PURPOSE OF TESTING A BETA PRODUCT IS TO OBTAIN FEEDBACK ON PERFORMANCE. CLIENT IS ADVISED TO USE CAUTION AND NOT RELY IN ANY WAY ON THE CORRECT FUNCTIONING OR PERFORMANCE OF THE BETA PRODUCT.
Additional Terms
- JobTarget makes no representations or warranties with respect to Messaging, the data accessed and/or Client’s use thereof, including but not limited to whether Client will receive desirable or satisfactory results from use of Messaging. JobTarget makes no guarantees that all messages and communications will be sent or received or that messages and communications will be free from error or displayed correctly. Such use shall be at Client’s sole risk. JobTarget does not guarantee the delivery or receipt of messages sent through Messaging.
- Job seekers may choose to block communications from an employer. If a job seeker requests that Client cease contacting them, Client agrees to no longer reach out or communicate with the candidate through Messaging.
- JobTarget reserves the right to turn on or enable Messaging for certain job postings or job seekers in its discretion and to notify job seekers that Messaging is available for a particular job posting or employer.
- JobTarget reserves the right in its sole discretion to restrict Client’s access or use of JobTarget’s services or to disable Messaging without prior notice.
- By using Messaging, you are agreeing to allow JobTarget to share Client’s users’ names, titles, and possibly other information, as controlled in the JobTarget Settings App, with job seekers.
- Information provided by job seekers is self-reported, is not verified by JobTarget and may be inaccurate or outdated.
